) - Five Alabama families have filed lawsuits claiming the University of Alabama at Birmingham’s Department of Pathology removed the organs from dead Alabama Department of Corrections inmates without permission from family members.

After the autopsy was performed, Singleton’s family requested his body be sent to Usrey Funeral Home in Pell City, Alabama. The funeral home received Singleton’s body Nov. 6. The lawsuit states, “The ward attendant confirmed the organs had been removed and retained by the UAB pathologist at the conclusion of Decedent Singleton’s autopsy, which is believed to have been ordered by an ADOC warden or agent.” The ward attendant further claimed, “Organ removal was standard practice and suggested it was legally permissible.’Jim William Kennedy died April 13, 2023 while in ADOC custody where he was housed at Limestone Correctional Facility in Limestone, Alabama.

The family stated they wanted to claim Kennedy’s body and requested it to be sent to Southern Memorial Funeral Home in Eufaula, Alabama. The lawsuit alleges UAB told the sister-in-law, “UAB is a teaching institution. And every teaching institution that does autopsies keeps their organs.”Arthur Olen Stapler died Sept. 23, 2023 at Brookwood Baptist Medical Center where he was receiving care while in ADOC custody. Before being transferred to the hospital, Stapler was housed at the Hamilton Aged and Infirmed Center in Marion County, Alabama.Stapler’s family requested a second, private autopsy.

The autopsy specifies, “permission for an unlimited autopsy is granted under the authority of the warden of Hamilton A&I Correctional Facility.” On June 30, 2023, the funeral home received Brackin’s body. The lawsuit states, “That same day, the Brackins Family asked the Funeral Home whether they could have an independent autopsy done. The Funeral Director informed the Brackins Family an independent autopsy would not be possible, as none of the organs had been returned with Decedent’s body and the body had already been embalmed by the UAB Defendants and/or Fictitious Defendants while the body was in the possession of the UAB Defendants.

“The Brackins Family told the UAB Defendants’ Department of Pathology employee that they wanted to bury Decedent Anthony with all of his organs, and the employee responded that it was ‘too late now’,” according to the lawsuit.Kelvin Lamar Moore died July 21, 2023 at Limestone Correctional Facility in Limestone County, Alabama. The chaplain told the family Moore died of a fentanyl overdose.
