A lawsuit in Oregon alleges a school district and an after-school program failed to protect a 3rd grader from ongoing sexual harassment that culminated in rape.

The court documents allege that during the 2021-2022 school year, the girl was attending Scott Elementary School in NE Portland, as well as an after-school program at the location called Schools Uniting Neighborhoods. The program is run by the non-profit Latino Network. Then, in April 2022, the lawsuit reports two different male classmates in the girl's after-school program threatened the 9-year-old and told her to tell the staff she had to go to the bathroom.
Following the assault, the lawsuit states the father of one of the boys reported his son and the incident to PPS staff. The father did not believe this would protect his daughter and disenrolled her from Scott Elementary. The classmates were allowed to remain at Scott Elementary and continue with their education after a one-day suspension.
"PPS and its agents fell below the applicable standard of care, were negligent, and unreasonably created foreseeable risk of harm to children, including Plaintiff, in one or more of the following ways:
