Former AFL star Gary Ablett Senior is suing his two former clubs Hawthorn and Geelong, claiming they knew the risk of concussions and breached their duty of care.

Current players who suffer head injuries must undergo strict concussion protocols, but this wasn’t always the case and “you feel for players like Gary Ablett who may be suffering from the effects of concussions,” says Thomson Geer Lawyers Media and Litigation Lawyer Justin Quill.

“He played in a different area, the knowledge and understanding of concussions in just injuries and the effects of it just didn’t exist, so he’s got some range of issues in this litigation,” Mr Quill told Sky News Australia host Chris Kenny. “He’s not only got to show that the effects that he’s feeling now were caused by the concussion, he’s also got to show that the decisions that were made at the time didn’t comply with the standard of care that they needed to.

“That really requires a bit of knowledge and I’m not sure he’s going to be able to show that there was enough knowledge around in the 80s and early 90s for that to be shown.”
