An Albanian criminal's deportation from the UK has been partially halted due to concerns about the impact on his young son. Klevis Disha, 39, entered the country illegally as an unaccompanied minor and later fabricated his identity, claiming to be from the former Yugoslavia. Disha was stripped of his British citizenship in 2021 after serving two years in prison for possessing £300,000 believed to be criminal proceeds. He had acquired his citizenship through deceptive means.

An immigration tribunal decided that deporting Disha to Albania would be unduly harsh on his 10-year-old son, referred to as 'C' in court documents. The tribunal cited the boy's food sensitivities, sensory issues, and difficulties expressing emotions as reasons for concern. While 'C' lacks a formal diagnosis, the court argued that deportation could negatively affect his emotional regulation, independence, reading, and writing abilities.Home Secretary Yvette Cooper appealed the initial judgment in August 2022, contending that there wasn't sufficient evidence to support the claim that Disha's deportation would be unduly harsh on his son. An upper tribunal judge, David Merrigan, agreed with the appeal, referring the case back to a new judge for further review. Judge Merrigan stated that the tribunal's decision relied solely on one isolated example of why 'C' could not return to Albania and that this single instance did not reach the level of harshness required to deem deportation unduly so. The case remains ongoing.
