One of Scotland's largest local authorities, North Lanarkshire Council, is facing a £45 million lawsuit from infrastructure firm Amey over a road maintenance contract. Amey , which had managed road repairs and maintenance for the council for 13 years, claims the council unfairly awarded a 12-year, £450 million contract to German firm Hochtief PPP Solutions. Amey argues that Hochtief submitted an 'abnormally low' bid and should have been excluded from the tender process.
The lawsuit, filed in the Court of Session, alleges that North Lanarkshire Council failed to act transparently by not addressing Amey's concerns about the contract award and neglecting to provide requested information within the legal timeframe. Amey further claims the council wrongly scored its bid and should have disqualified Hochtief due to concerns about its capability to fulfill the contract.Initially, the decision to award the contract to Hochtief was suspended, but in June 2022, Lord Craig Sandison lifted the suspension. The council then announced Hochtief as the winner in August 2022. The Court of Session will now hear arguments from both sides regarding the contract award and determine if Amey is entitled to the £45 million in compensation it seeks. Several councillors are expected to provide evidence in the case. This contract is part of the council's Enterprise Project, which aims to secure long-term deals with firms for managing housing repairs and road maintenance. Previous controversies involving the council include awarding a £1.8 billion public service contract to Mears, a firm subsequently found to be manipulating performance figures.
