Fears for weekend crime wave with courts in 'chaos' and prison bosses warning of 'absolutely desperate' situation
Modelling by police chiefs forecasts that custody suites across the country will run out of space within three days if people cannot be transferred into jails, making normal arrest procedures impossible and creating the risk of unchecked criminality. “It is not simply a matter of Operation Early Dawn causing an issue with trials on the day, it is a system that has fundamentally broken,” they said.Stuart Nolan, chair of the Law Society’s criminal law committee, said the situation was driving “delay and chaos across the system”.
But Mr Fairhurst said Operation Early Dawn was so far “working as expected” and he believed that prisons would “just about scrape it” to 10 September without Operation Brinker being triggered.The exceptional measures are being taken because of fears at the highest levels of the criminal justice system and government that law and order will break down in Britain if prisons become totally full.
Lord Justice Green, the deputy senior presiding judge of England and Wales, wrote that the direction was necessary “in the context of the current challenges in our prisons”, adding: “Every case must be considered on an individual basis and decisions must be made on the basis of the interests of justice.”
Stuart Nolan, chair of the Law Society’s criminal law committee, fears that while it will ease pressure in the short-term, “there will be problems down the line” with reoffending because probation services risk being overwhelmed. “It’s just creating a problem somewhere else,” he added. “They’re pressing on one bit and it pops up further down.”
