A Lancashire bar linked to concerns over alleged noise, drugs-use and disturbance to neighbours has been allowed to vary its licence to serve alcohol later at night and to keep live and recorded music inside

Mr Fletcher’s initial license application was met with objections from some residents along with concerns from Burscough Town Council. Police also sent a report to West Lancashire Council, highlighting a number of incidents including traces of cocaine being found on a table at the bar. Various borough and town councillors were at the licensing variation meeting this week, along with a police officer and an environmental health officer who had previously raised concerns.

She also said license holder Mr Fletcher had the right to submit a variation application for the Cactus Ray’s outdoors seating area , even though another license covering the whole site is held by the wharf owner. The spirit of the law encouraged different organisations to work with landlords on licensing issues, she added.

She added: “We have had letters of support from residents. Our customers include serving police officers. They come with their families. We also have an 80-year-old customer from Leigh. They would not come if our venue was the type of bar which Burscough Town Council makes us out to be.” Mr Fletcher said: “We are helping the police by keeping a log. I walk around the perimeter usually around 9pm. We have a decibel monitor and also use my phone. There are also other venues at the wharf which have music. One of them is just a couple of doors away. I control the PA system and turn it off when performances finish. ”

PC Connolly also said tougher sanctions on venues which breach conditions are available to the police, if needed. These included closure notices, fines and up to six months in prison for license holders found guilty of the most serious offences. But he added: “Mr Fletcher made errors in the summer. But things have changed. If I had no confidence in him now, I would not put-forward these new suggested licensing conditions.
