A pub in Chilwell which was told by Broxtowe Borough Council to get rid of its beer garden is still fighting to keep it seven months on. The owners of the Berliner, on High Road, have now applied for retrospective planning permission for a sound-proof fence they have built around their back yard to keep noise in.
Curtis and Katie were told to apply for retrospective planning permission and assumed they'd get the green light. But it was rejected and they were given four weeks to get rid of the outdoor seating area. A statement of justification included with the planning document says: "The outdoor area is not only beneficial to patrons of our business, it also provides a safe and contained area for fresh air and smoking and prevents this taking place on the narrow and public road at the front of the property.
"To conclude, the space has been in operation for seven years with no concern, and provides benefit to local customers and is beneficial to the operation of our small business. We hope this statement provides a satisfactory basis for fair consideration of our application."
