Biden argued that the House of Representatives' rapid passage of the legislation left important questions unanswered, particularly regarding the allocation of new judgeships and the impact of senior status and magistrate judges on the need for additional positions. He also expressed concerns that the bill prioritized political gain over judicial efficiency, noting that it would create new judgeships in states with existing vacancies.

The measure would have increased the number of trial court judges in 25 federal district courts in 13 states in six waves every two years through 2035on Monday vetoed a once-bipartisan effort to add 66 federal district judgeships, saying “hurried action” by the House left important questions unanswered about the life-tenured positions.

The Democratic-controlled Senate passed the measure unanimously in August.
