A foreign rapist who claimed he was unaware of having sex with a sleeping woman cannot be deported due to his bisexuality, a tribunal ruled. The Home Office argued he was a danger to the community, but the tribunal cited fears for his safety in Jamaica.
A 41-year-old foreign man who was convicted of raping a sleeping woman in 2018 cannot be deported because he is bisexual, a specialist tribunal heard. The man, originally from Jamaica, claimed he was not aware he was having sex with the woman while she was asleep. The tribunal was told that he would be targeted by violent gangs due to his sexuality if he was returned to Jamaica.
He was sentenced to seven years in jail for the sex attack which happened at a party, but released in 2021 after serving half of his sentence. Before his release, a deportation order was issued by the Home Office who described him as a 'danger to the community' and sought to deport him under the 2002 Asylum Act. The Sun first reported the story. The man, whose name is anonymous for his protection, challenged the decision. He was brought to the UK by a relative in 2001 after falling victim to several attacks in Jamaica due to his bisexuality. During the attacks, he claimed to have been struck with a 'metal bar, machete and dogs.' He also claimed an older man he had been in a relationship with was killed for being gay. However, the Home Office said they could only find evidence of the man being with women since he arrived in the UK aged 18. Former security minister Sir John Hayes said: 'This is an insult to every victim. 'This man should be thrown out of the country.' The Home Office said: 'We made the case to deport this individual and lost in the courts.
