Australian careers expert Sue Ellson has weighed in on how a proposed change could impact you.

Under the proposed amendment to fair work laws, workers could have the legal right to ignore their employers via calls, emails and texts when they are off the clock — unless they’re getting paid for it.

“However, a lot has changed over the last 10 years. How often do employees check their social media, attend to personal matters, or take time to respond to private messages or calls on employers’ time?” “Ultimately, in an ideal world, this would be another work condition that is part of the employment arrangement. Sadly, many employers could assume that a person is meant to be available whenever they want, but if it is part of legislation, it will make sure that employers do comply with a reasonable trade of time, money and availability.

“I think this will be one of those things where in theory you have a technical legal right to ignore your boss’ email, but the email is probably going to come if it’s important enough and bosses will always think it is important enough and they will probably always favour the people who respond to it.
