Data from the phone of a woman who police allege was raped by former Liberal party staffer Bruce Lehrmann has been received by his lawyers, a court has heard.
Lawyers for former Liberal Party staffer Bruce Lehrmann, who faces two rape charges over incidents alleged to have happened west of Brisbane, have received a data download from the complainant's mobile phone.Mr Lehrmann has indicated he intends to plead not guilty to two charges of rapeThey have asked for several weeks to review the data and to work out which witnesses they want to cross-examine at a committal hearing.
Mr Lehrmann's solicitor, Rowan King, appearing via telephone, told the court the mobile phone material had been disclosed on Tuesday of last week but was not in a format to be downloaded until Thursday of last week.Mr King said there were some "clerical matters" regarding the mobile phone data provided by the Crown, which consisted of 400-500 files which were locked.
His Canberra trial on the matter related to Ms Higgins was aborted in October last year amid claims of juror misconduct and further legal proceedings were dropped by the prosecution.The Toowoomba case has been mentioned in the Toowoomba court multiple times throughout this year but Mr Lehrmann had not been required to attend and his identity had been a secret.
Sitting in the Supreme Court on October 26, Justice Peter Applegarth found there was no compelling reason for a non-publication order to protect Mr Lehrmann's safety. He said that was hard to reconcile with the psychologist's report tendered during the non-publication order hearing."The evidence included the presentation of the applicant in media interviews and the fact that he made no mention in them of being in a poor psychological state for reasons he did not wish to disclose to the public," Justice Applegarth said in his judgment.
