"CISA was the 'primary facilitator' of the FBI's interactions with the social-media platforms and worked in close coordination with the FBI to push the platforms to change their moderation policies to cover 'hack-and-leak' content," the 5th Circuit said in its decision. The 5th Circuit further concluded that CISA acted as a"switchboard" for funneling moderation requests to social media sites that were flagged by state and local officials, but didn't stop at requesting censorship of offending posts.
