On Tuesday, Clayton filed a motion to dismiss the indictments, arguing that Simpkins faces double jeopardy. Simpkins is being charged with “the same conduct, or a different offense arising out of the same criminal episode,” and the charges should have been consolidated into one trial, according to the motion.
One of the cases Simpkins is currently facing alleges aggravated assault in connection with a Sept. 26, 2021, incident. According to the indictment, Simpkins fired at — or in the direction of — a vehicle that was driving away.An Arlington police detective shared evidence that indicated Simpkins sold marijuana and prosecutors pointed to it as a reason for why he was at the gas station.Another officer showed a series of texts and web searches from Simpkins’ phone in the days after the robbery.
