Ms Bradley, 29, a digital marketing teacher from Merseyside, is now fighting to help Youssef stay in the UK. However.rules stating that couples must be married or have lived together for two years mean they cannot apply for a spousal visa.
“The Home Office is failing to acknowledge the fact that we’re in a relationship because we are not cohabiting at the moment.as that is our personal standpoint. But because we are not cohabiting, the Government is speculating whether we’re actually a couple.” Home Office guidance states that couples can apply for a fiancé permission which gives an individual UK residency up to six months prior to marriage without a couple having to live together.
His lawyer Usman Aslam, senior associate at Mukhtar and Co Solicitors, managed get the removal cancelled after going to the Court of Session, the highest civil court in Scotland, and Mr Mikhaiel was released from the Dungavel Immigration Removal Centre after two weeks.
