Lachlan Murdoch’s lawyers say Crikey made a nearly $500,000 “windfall” from Murdoch-related coverage in August last year.

“Having achieved their commercial objective, having also received donations from members of the public of over $500,000, and having put no evidence of their financial resources – that they’re insured for these claims – the submission that my client’s resources should be taken into account should be rejected,” she said.

Crikey ran a half-price subscription drive after the article was published, charging $99 instead of $199, Ms Chrysanthou said.She argued that amending the claim was necessary after what Mr Murdoch’s legal team had learnt from internaldocuments, and, crucially, after they realised they had not included the August 15 article in the case.“Call it a mistake, call it a decision – it doesn’t matter,” Ms Chrysanthou said.

“Nowhere in your affidavits have you explained why you originally made the forensic decision not to sue on the reposted article,” Mr Hodge said.“That decision was based on privileged conversations with my client,” Mr Churchill replied.said outside court: “We’ve been open all along about the principles we’re standing up for. We feel just as strongly about those principles and about free speech as we did when this started … we look forward to defending our actions in court.

Justice Michael Wigney allowed Mr Murdoch to amend his claim and include the June 29 and August 15 articles, as well as add Mr Beecher and Mr Hayward, but ordered that Mr Murdoch pay most of the associated legal costs. He set the hearing down for three weeks from October 9. The case returns to court on Thursday, February 2, for a brief hearing.
