Neil Speakman denies gross negligence manslaughter following son Albie's death
Jurors have heard closing speeches in the trial of a man accused of killing his own son in a farm vehicle incident.
While Mr Speakman had used the machine before, he was not trained and the court heard that the machine was ‘defective’, as one of the wing mirrors was missing and the other was ‘so dirty as to be useless’. In closing speeches by both the prosecution and defence, Mr Elvidge said that Mr Speakman ‘did not bother’ to look after his son. But Alexander Leach KC, representing Mr Speakman said his client was ‘constantly assessing the risk’ and that the incident was a ‘tragic accident’.
“The prosecution say Albie was obviously vulnerable because of his young age and his size, his understanding and his unpredictability. That is what Mr Speakman should be thinking about.” The prosecutor said the defendant gave ‘no thought’ to the possibility that Albie could have been nearby, and suggested the safe thing to do when he didn’t see him in the garden was to ‘just stop'.
A letter was sent by the HSE to Mr Speakman warning him of the potentially fatal consequences, the court heard.
