A Lanarkshire DHL worker who was fired after being off work sick for two years has had his compensation bid rejected.

In January 2020, Mr Milrine claimed he became unwell as a result of a workplace incident in 2016/17, which had led to him raising a grievance that was partially upheld. When asked in February 2020 by DHL's transport manager Hazel Doogan if he would consider alternative work, he said he felt too unwell and feared driving too and from the office after being advised not to do so by the DVLA.

Ms Doogan told Mr Milrine that she would look into him possibly working from the company's sites in Cumbernauld or East Kilbride while his licence was revoked. The next meeting took place in October 2021, by which time Ms Doogan and Marion Cooper had been promoted to transport team leader. Ms Cooper and HR employee Claire Gard sat in the meeting with Mr Milrine.

When he was asked if there was anything DHL could do to support him, he replied: "I don’t think so Marion, I don’t even have my car licence and I don’t know if I will be able to drive again, you never foresee these things." After a further meeting in May 2022, Ms Cooper told Mr Milrine a medical capability hearing would be held where "one potential outcome was his dismissal".
