Peggie filed a complaint against both Fife health board and Dr Upton after three incidents involving shared changing room facilities.

The dispute stems from an incident on Christmas Eve 2023, where Peggie objected to Dr Upton's use of the female-only changing room. Following this, Peggie was suspended by NHS Fife, facing allegations of bullying and harassment stemming from a complaint filed by Dr Upton. During the tribunal hearing in Dundee, Dr Upton vehemently denied any attempt to assert dominance over Peggie. She claimed her actions were aimed at de-escalating the situation and that Peggie's questioning was aggressive and pejorative. Dr Upton, who has worked for NHS Fife since August 2023, argued that the terms 'biological male' and 'biological female' lack a clear and universally accepted definition. She stated that understanding an individual's biological makeup is important, but there is no consensus on defining 'biological sex'. Peggie's lawyer, Naomi Cunningham, compared Dr Upton's insistence on being perceived as a woman to the manipulation of language depicted in George Orwell's dystopian novel, *Nineteen Eighty-Four*, where individuals are forced to accept falsehoods.
