A speeding drunk driver who had to be rescued from his burning car after a horrific crash has been sentenced to three years in prison. Andrew Smart was driving at 85 miles per hour in a built-up area of Newmains when he lost control of his Ford Focus and collided with two other vehicles. Smart, two of his passengers, and another driver sustained serious injuries. The 31-year-old admitted to driving dangerously at a “grossly excessive” speed while under the influence.
The crash occurred at the junction of Overtown Road and Main Street around 8:30 pm on February 22 last year. Robbie McDougall, prosecuting, told Hamilton Sheriff Court: “The accused overtook a vehicle as he entered a 30 miles per hour area. He was driving at approximately 85 miles per hour. “He tried to turn left onto Main Street but was unable to maintain control and his car collided with a Vauxhall Corsa that was waiting at the junction. “The accused’s car continued for a short distance and collided head-on with an Audi. Smart’s car caught fire and members of the public stopped to help get him out.” One of his two male passengers suffered a broken arm and leg, as well as burns to his torso and legs. The other had spinal, pelvic, and arm fractures and required multiple surgeries. Smart himself had a spinal fracture, burns to his hands, and cuts to his face, while one of the other drivers sustained a broken ankle. Mr. McDougall added: “Police noted a strong smell of alcohol from the accused. It’s accepted he was under the influence at the time though no blood sample was taken.” Defence lawyer Stephen MacBride said dad of one Smart has “no recollection” of the crash, adding: “He is truly sorry for the consequences that arose and bitterly regrets his actions. “I submit he could benefit from a community disposal that would allow the court to keep an eye on him
