Erik Cantu, the teen who was shot by an SAPD officer outside a McDonald’s in 2022, has filed a civil lawsuit against former SAPD officer James Brennand and the City of San Antonio.
–
The lawsuit states that Cantu suffered physical injuries including damage to his stomach, diaphragm, lungs, liver, bicep, and forearm; he spent several weeks on a ventilator and nearly died. “Plaintiffs have serious and legitimate complaints about the City and its policymakers for the policies, procedures, training, culture, and lack of enforcement that directly led to this shooting and Plaintiffs’ injuries,” according to the lawsuit, which also alleged that Cantu was racially profiled.

The trial is scheduled to be held in San Antonio in mid November. The legal council for the former officer requested the venue change due to the media attention the case has received. Brennand was indicted in December of 2022 for shooting 17-year-old Eric Cantu 10 times in a McDonalds parking lot. Body camera footage shows Brennand open Cantu’s car door, and ask the teen to get out of the car. Brennand then opened fire when Cantu reversed and drove off with his door open. Cantu was left critically injured after the incident, spending several weeks in the hospital after the shooting Chief William McManus said was unjust.
