A former Johnson & Johnson policy advocate is suing her former employer, alleging that its contract with Express Scripts, a pharmacy benefit manager, resulted in millions of dollars in higher drug costs for employees.
Ann Lewandowski, a former policy advocate at drugmaker Johnson & Johnson , filed a lawsuit against her former employer, alleging that its contract with pharmacy benefit manager (PBM) Express Scripts resulted in higher drug costs for employees.
Lewandowski, who was fired in April, claims that J&J's choice of Express Scripts, part of insurance giant Cigna, led to millions of dollars in increased expenses for employees in the form of higher premiums, deductibles, coinsurance, copays, and lower wages. She argues that J&J failed in its duty to ensure reasonable drug prices for its over 50,000 U.S. employees. Lewandowski, who requires an expensive multiple sclerosis drug, filed the lawsuit because she experienced a conflict between her knowledge of PBM practices and her personal experience as a health plan user. Recent scrutiny of PBMs' opaque business practices includes an FTC investigation and bipartisan congressional bills aimed at regulating them.
