Allan Marshall died in hospital four days after being restrained by up to 17 prison officers at HMP Edinburgh in March, 2015.
The family of Allan Marshall who died in custody after he was held down by prison officers are taking legal action against the Scottish Prison Service , the Crown Office and Scottish ministers over his death.

The case has now been re-classed as a criminal matter and the men could be called to give evidence at any future trial against the SPS but their lifelong protection remains in place. Guards realised Allan had stopped breathing and one nurse who arrived on the scene tried to resuscitate him.
