An Elyria woman died of a opioid overdose after being released from the hospital and sent to the Lorain County Jail, according to a lawsuit filed in federal court in Cleveland.
The family of a woman who died after being taken to the Lorain County Jail filed a lawsuit against a hospital that treated her and jail officials.CLEVELAND, Ohio — The brother of an Elyria woman has sued the Lorain County sheriff and a local hospital over her death from an opioid overdose.
Cleveland.com and The Plain Dealer reached out to Sheriff Phil Stammitti and Mercy Health spokeswoman Maureen Richmond for comment.The lawsuit, filed on behalf of Diaz’s estate by attorneys Jeremy Tor and Matthew Besser, accuses Mercy Hospital of negligent medical treatment and jail staff of being deliberately indifferent to Diaz’s medical needs.
While treated at the hospital, a sheriff’s deputy told medical officials he planned to take her to jail after treatment. Diaz had a warrant out for her arrest for failing to appear in court on a misdemeanor charge of driving under suspension. A nurse observed her for several minutes while she sat on the ground, unable to open her eyes, before deputies escorted her to be booked.
For the next several hours, her condition deteriorated. Her breathing slowed at 12:41 a.m. About an hour later she gasped for air. Another inmate saw her drooling and not breathing and called for help.
