Two North Yorkshire farmers have admitted health and safety breaches following the death of a dog walker who was fatally trampled by their cows. The case, which took four years to conclude, resulted in the farmers pleading guilty to failing to ensure the safety of the public on their farm.
Two farmers in North Yorkshire have admitted health and safety failures following the death of a dog walker who was fatally crushed by their cows in September 2020. David Clark, a 59-year-old teacher from Richmond, was attacked while walking his two dogs. Brothers David Turnbull, 60, and Andrew Turnbull, 57, were initially facing a full trial but pleaded guilty to a lesser charge of failing to ensure the health and safety of persons other than employees while operating a farm.
The prosecution accepted this plea and a fine is the most likely punishment when they are sentenced on March 3rd at Teesside Crown Court. An inquest previously heard that Mr. Clark, the deputy head of Richmond School and a former Scotland Under-21 rugby player, was attacked while walking his two dogs. Judge Jonathan Carroll, presiding over the hearing, expressed his concern at the length of time it took for the case to be resolved, stating that it should have been concluded years ago. He criticized the prosecution and defense barristers for allowing the case to drag on for four years, deeming the delay 'unfair' to both Mr. Clark's family and the Turnbull brothers. The judge acknowledged that the prosecution accepted a basis of plea from the farmers, which centered around the insufficiency of warning signs advising walkers to take an alternative route. Judge Carroll emphasized that while a fine is likely, he expects to hear details about the specific measures the Turnbulls will implement in the future to safeguard the public from potential livestock-related incidents.
