Speakman, 39, maintains his innocence to charges of gross negligence manslaughter, stating that the accident was a devastating mistake. He told Manchester Minshull Street Crown Court that the incident had 'ruined my life'. Mr. Speakman described the moment of the accident, saying he felt an immediate bump and stopped the vehicle instantly. He wiped away tears as he testified, expressing that he shouldn't have to relive this experience and calling it 'not fair'. The prosecution alleges that the garden where Albie was playing was insecure, allowing him to wander into the yard where his father was working. They further claim that the Kramer telehandler had several defects, including a missing wing mirror. Mr. Speakman denied seeing his son, stating that he meticulously checked for blind spots due to the missing mirror. He claimed to have seen Albie playing in the garden with the family dogs seconds before the collision. Mr. Speakman admitted that he shouldn't have left his son in the garden, acknowledging his mistake. The court also heard that Mr. Speakman had received a warning from the Health and Safety Executive (HSE) in 2020 regarding the use of another piece of farm machinery, but he denied ever receiving such a letter
