“A lot of people would find that not in the spirit of being a nonpartisan entity but … it’s not a violation of the Hatch Act,” Kappel said, referring to the law prohibiting certain political activities by federal employees. “It’s not against the ethical rules that are now in place for FEC commissioners.”In response to questions about the yard sign and whether Trainor would recuse himself from the Cruz complaint, an FEC representative said Tuesday that Trainor “has no comment.
Rachel Nelson, spokesperson for iHeart subsidiary Premiere Networks, has said those payments are associated with the podcast’s advertising revenue. She said Tuesday that the podcast is “owned” by Truth and Courage, which has not responded to emailed requests for comment. The FEC has six commissioners who are appointed by the president and confirmed by the Senate, with no more than three belonging to the same political party. That structure is intended to make the agency as nonpartisan as possible, and official actions require support from at least four commissioners.
