A judge has warned the claimant against being deliberately obstructive in future proceedings
The former employee of a Leyland software firm has had parts of his employment tribunal claim thrown out after he was found to be "deliberately obstructive" in court proceedings.
The employment tribunal judge did not agree and said that Mr Chima's comment, “if the employer refuses to negotiate and pay me a severance package to break ties amicably then an Employment Tribunal claim will be launched immediately”, was ambiguous. Mr Chima also provided false information to the tribunal when he claimed he had not received documents from his former employer.
Despite noting Mr Chima's behaviour Employment Judge Slater refused to strike out the claim and ruled: "I do not consider his conduct has reached such a stage that a fair trial is no longer possible. I do not, therefore, strike out his remaining complaints on this basis.
