🔴 Any decision by the UK Government to block Scotland’s reforms to gender recognition laws would be both lawful and constitutional, according to a paper published on Thursday
In his paper, Dr Foran argued that these changes would have several effects on the Equality Act, including changing the meaning of the protected characteristic of “sex”.
Other issues include an impact on the law in relation to single-sex associations, which cannot discriminate on the basis of gender reassignment, and on single sex schools. “There is no exception for gender reassignment discrimination in relation to schools. This Bill will confer on certain biological males a legal right of admission to girls’ schools, a right which otherwise does not exist.”This would almost certainly be contested by Scottish ministers through a judicial reviewA UK Government spokesman said it was “looking closely” at the issues raised in the paper including the ramifications for the Equality Act and other UK-wide legislation.
