‘The Government cannot stand by and let unlawful strike action go ahead,’ Steve Barclay saidThe Health Secretary has confirmed he will ask the High Court to declare a looming nurses’ strike unlawful, in a dramatic escalation of tensions with theThe Government and NHS Employers claim that the 48-hour walkout, set to begin at 8pm on Sunday and end next Tuesday evening , breaches the legal mandate that the union received from members to take strike action.
“I firmly support the right to take industrial action within the law – but the government cannot stand by and let unlawful strike action go ahead nor ignore the request of NHS Employers.In a letter to RCN general secretary Pat Cullen, he said: “I had hoped that you would reflect over the weekend and offer to call off the strike on 2 May.
“Given that you have chosen not to do so, I intend to apply to the High Court to declare the action you have planned unlawful.” In a message to union members, Ms Cullen said: “Tonight, the threat sadly became a reality. We told the government that this is wrong and indefensible. The only way to deal with bullies is to stand up to them – including in court.
