When drivers struggle to find parking spaces, many will resort to parking on the road. While they might assume it's acceptable as long as they aren't double-yellow lined or obstructing anyone, they could unknowingly be breaking a lesser-known parking rule. Most drivers perceive double parking as blocking someone in by parking too close or preventing their exit. However, the double parking regulations also encompass situations where drivers pull up and park adjacent to the curb.
The Highway Code explicitly states: 'You must not leave your vehicle or trailer in a dangerous position or where it causes any unnecessary obstruction of the road.' This rule can apply to vehicles parked too far from the curb, specifically within 50cm. If your car is parked on the road and 'no part of the vehicle is within 50cm of the edge of the carriageway (kerb line)', you could receive a Penalty Charge Notice (PCN). 50cm, roughly the size of a wheelie bin lid, signifies the permissible distance from the curb.An exception to this rule exists when your car is 'wholly within a marked parking bay'. This implies that if you are parked away from the curb but within a designated parking bay, you should ensure you haven't overstepped the marked lines. Conversely, some drivers may mount the curb to park, which can also result in a fine. While parking on the pavement isn't illegal in most areas of England and Wales, except London and Scotland, obstructing pedestrian passage could still lead to a PCN. There are ongoing discussions to potentially ban pavement parking entirely across England, though no concrete date has been established. PCNs can vary in price depending on the local authority but generally range from £50 to £80. Some councils offer discounts of up to 50% if the fine is settled within 14 days. However, they may impose additional charges if payment is delayed beyond a month. Individuals who fail to pay their PCN may face court action, potentially escalating the cost by hundreds of pounds. It is also a common reason for receiving a CCJ (County Court Judgment), which can negatively impact your credit score
