The ad, which is set to air during Sunday's Super Bowl, directly criticizes the $160 billion weight loss industry. It highlights existing weight loss medications known as GLP-1s, including visuals of injection pens resembling brand-name medications. Hims & Hers positions its own weight loss medications as 'affordable' and 'doctor-trusted' alternatives, claiming that existing GLP-1s are 'priced for profits, not patients.'The senators, in a letter to the U.S. Food and Drug Administration (FDA), point out that the ad lacks any disclosure regarding potential risks, side effects, or safety information, which is typically required in pharmaceutical advertisements. They also note that a brief, nearly illegible disclaimer mentioning that the products are not FDA-approved flashes on the screen for only three seconds during the minute-long commercial. Scott Brunner, CEO of the Alliance for Pharmacy Compounding, defended Hims & Hers' ad, arguing that it aligns with 'help-seeking' pharmaceutical advertising guidelines, as it encourages viewers to consult with a healthcare provider rather than promoting a specific drug.Hims & Hers, in a statement to CNBC, emphasized its compliance with existing laws and expressed willingness to collaborate with Congress and the new Administration to address the 'broken health system.' They aim to ensure patients have access to 'quality, safe, and affordable healthcare.' However, the senators, while not naming Hims & Hers directly, believe the ad exploits a loophole regarding promotions of compounded drugs by telehealth companies.
