The ECHO takes a look at the arguments between Nottingham Forest and the Premier League and how they may relate to the cases against Everton
Nottingham Forest were plunged into the relegation zone without a ball being kicked on Monday after the club was handed a four point deduction.
READ MORE: Everton points deduction: Commission's Nottingham Forest explanation can only lead to one outcome for Premier LeagueForest submitted its PSR calculation on the new deadline agreed by clubs last year - December 31, 2023. The submission date was brought forward to help ensure that breaches were dealt with in the season they were found - something that was not possible with Everton’s first case, essentially because the charging date came so late into the campaign.
Crucially, it also argued it deserved credit for admitting the breach in full at the first opportunity and for co-operating extensively with the process. The Premier League agreed on those two procedural points and actually argued Forest’s punishment, however many points it would be, should be reduced because of it. The league accepted it amounted to “substantial mitigation which together justify a material reduction in sanction”.
The Premier League countered that whether or not full valuation was obtained for the player was irrelevant. It argued: “Forest should have had no choice: the sale had to happen before the end of June 2023, or it would breach the PSR Threshold. Further, it was expressly warned by the Premier League on 6 June 2023 about this.”
This is where the commission was perhaps most damning with Forest, arguing one interpretation of the club breach could be that: “Forest bought extensively in summer 2022, knew it was in trouble with PSR before the end of 2022 and rather than sell one of its best players in the January 2023 window or indeed any other players, it bought more players in that window and its PSR position got worse.
