Special prosecutor Jack Smith's case against Donald Trump has been ripped apart, but can the Supreme Court save the day?
The Supreme Court will likely agree with the dismissal of Donald Trump's classified documents case, a legal analyst has told Newsweek.Greg Germain, an attorney and law professor at Syracuse University in New York, was reacting to Judge Aileen Cannon's decision on July 15 to dismiss the charges against Trump. Within hours of her decision, special prosecutor Jack Smith received permission from the Department of Justice to appeal the decision.
'If and when it gets to the Supreme Court, I think they will say, by a divided majority, that Cannon was right in ruling that the special prosecutor's appointment violated the appointments clause,' Germain said.However, he added that the Supreme Court will likely tell Cannon that she could have handled it differently by allowing the DOJ to rectify the problem.
