Dallas city leaders are right to raise concerns that town halls may veer into political advertising, but we worry that the city may be overreacting.
There is a difference between political advertising and education.Dallas City Hall seems to have quieted down for spring break. But as we hurtle toward a bond election, it may be getting too quiet.about the propositions in the May bond election. The memo indicated that a town hall that went over individual projects in a bond proposition might break state law.City officials said they are figuring out when they can share a list of proposed bond projects with the public.
In fact, the Texas Ethics Commission has advised that detailed descriptions about bond proposals are OK as long as they don’t veer into advocacy. A disclaimer that a brochure isn’t intended to advocate for a measure doesn’t let a government off the hook. State officials look at the communication as a whole and search forto build a new jail was permissible. The brochure discussed the jail situation at the time, where a new jail would be built, the costs of a new jail and alternatives to building a new jail.
We think city staff can help inform the public in a neutral way.
