Vance said on X that the appellate court would not be able to hear new evidence from witnesses, as it would consider only material that was put before Cannon's court.'The parties have to file the 'record on appeal'—because appellate courts don't take evidence, they consider only material that was before the trial court, including pleadings and transcripts. Appellate courts don't consider any information that isn't in the record,' Vance wrote.
