Department of Justice prosecutors called former President Donald Trump's latest efforts to dismiss his classified documents case 'profoundly flawed' in a filing on Monday night.DOJ Special Counsel Jack Smith charged Trump with illegally storing classified documents at the former president's Florida estate, Mar-a-Lago, after leaving the White House in 2021 and resisting federal efforts to retrieve the files.
The prosecutors criticized Trump for claiming 'the precise order of the items within the boxes when they left the White House was critical to his defense' despite the 'backdrop of the haphazard manner in which Trump chose to maintain his boxes.''But neither the law nor the facts provide any basis whatsoever for the Court to find bad faith or spoliation in the unsurprising reality that the order of some of the items may have shifted since then,' they wrote.
