A Hays County judge, weighing whether to ease bail conditions for the man accused of setting a 2018 apartment fire in San Marcos that killed five people, said prosecutors can't wait indefinitely to decide whether to bring the case to trial. Magistrate Judge Daniel 'Matt' Burns made the remark during a brief court hearing on a defense motion to lighten pre-trial release conditions for Jacobe De Leon O Shea Ferguson , 31, of Austin.

That led to Ferguson's release from jail because under Texas law, a felony defendant cannot be held longer than 90 days without a grand jury indictment.

'We are not in any way trying to minimize the pain the families are feeling. 'This has greatly affected Mr. Ferguson's life as well,' she added. On hearing that remark, Dalia Moats Castillo, whose niece, Belinda Moats, 21, died in the fire, let out a soft sob and shook her head.
