The first major Capitol Hill action on tech in years passes the House with broad support — and steers straight into questions about national security, TikTok and the Senate.
Energy and Commerce committee leaders Frank Pallone and Cathy McMorris Rodgers introduced a bill to ban data brokers from selling Americans' information to foreign adversaries. It passed a House floor vote on Wednesday with 414 votes and no votes opposing it.
Though the bills were introduced together, and intended to complement each other, their politics are already diverging. Several progressive lawmakers who opposed the TikTok bill have lined up to support the data broker measure. Rep., the first Gen Z member of Congress, who took part in a rally last week defending TikTok, said that data brokers are the right target for Congress to focus on.
TikTok is an immensely popular app, with a vast user base of young people that creates political and free-speech concerns for many legislators. It may enjoy First Amendment protections that could help it sue to overturn the measure if it becomes law. A common criticism of efforts to ban TikTok, or force its sale from parent company ByteDance, is that the Chinese government could still buy Americans’ information through data brokers.In a seeming irony, however, it also hasn’t garnered much enthusiasm from privacy advocates. Though they have been pushing for a federal law for years, they’ve been muted in their support of this bill – worried in part that it would get in the way of more comprehensive law they’d like to see.
