Lawmakers on Wednesday took testimony on a proposed bill that would end abortion access in Alaska during a House Health & Social Services Committee meeting.JUNEAU, Alaska - sponsored by Rep. David Eastman, R-Wasilla, would criminalize abortion by making it possible for individuals who perform the procedure to face murder charges. In his sponsor statement, Eastman claimed that the bill would ensure that state law complies with the Alaska Constitution.

The bill would solidify under law that the term “child” is “a natural person from the moment of conception until 18 years of age.” The bill would also amend the state’s residency definition to add that a “pre-born child is a resident of the state if the mother of the preborn child is a resident of the state.” The bill further goes on to specify that an abortion is an action taken with the intent to cause death to a child.

In a memorandum sent to committee chair Mike Prax, R-North Pole, the Division of Legal and Research Services wrote that“Prohibiting abortion will force the Department of Health , to choose between violating a statute or a constitutional right,” the memo stated. “I do not know what the department would do in this situation, but the Alaska Attorney General has previously advised the department to pay for medically necessary abortions.

The department highlighted how the bill would make abortion illegal, regardless of if the fetus is viable and the health of the mother.
