Kerrville is violating the U.S. Constitution with two ordinances that limit canvassing and soliciting in the Hill Country city, a political advocacy group and several residents claim in a federal lawsuit. The lawsuit, filed in U.S. District Court for the Western District of Texas , accuses the Kerrville City Council of enacting a “scheme to protect incumbents by making the price of participating in civic matters too costly and burdensome.
Wonder where new Hill Country residents are moving from? You might be surprised. At issue are two measures passed by the Kerrville City Council. In March, the council approved an ordinance that requires anyone soliciting or canvassing in Kerrville to obtain a permit from the city. The permitting process requires paying a nonrefundable application fee, as well as undergoing a background check and being fingerprinted by the Kerrville Police Department.
Boerne Buc-ee’s edges closer to start of construction The other city ordinance mentioned in the lawsuit is one that places limits on campaign and election-related activities. The ordinance bans campaigning within 100 feet of a door through which voters enter a polling place. In Kerrville, that generally refers to the Kathleen C. Cailloux City Center for the Performing Arts, the city’s auditorium and largest polling site.
