A computer-savvy individual collaborated with a teenager to build a fraudulent Amazon website aimed at exploiting vulnerable individuals. While the website never went live, the court found the individual guilty of encouraging fraud.
A computer-savvy 'loner' teamed up with a teenager to create a fraudulent Amazon website with the aim of exploiting vulnerable individuals who lacked technical expertise. The court heard that Ewan McGavin, 31, from Horwich, Bolton, enlisted Blaine Flatt, then 16, to develop the fake site, which pretended to process Amazon refunds. The site, located at 'amzconfimations.us', was designed to capture users' login details and financial information, including bank card numbers.
Communication between the pair, primarily through WhatsApp, revealed McGavin's instructions to Flatt about the clandestine nature of their operation. However, the court learned that disagreements over payment emerged, preventing the launch of the phishing scam. Despite the website never going live, the court found McGavin guilty of encouraging or assisting in the creation of an article intended for fraud. The judge highlighted the potential for the scheme to significantly impact unsuspecting internet users. This case came to light after Flatt was investigated for possessing indecent images of children. During the 2020 police raid on his home in Bryn Cigfran, Bridgend, officers seized electronic devices containing over 180 indecent and abusive images of children, as well as evidence of cannabis dealing. Flatt was previously sentenced in 2022 to 24 months in prison, suspended for 24 months, along with 200 hours of unpaid work, a 10-year sexual harm prevention order, and registration as a sex offender. During Flatt's sentencing, his barrister emphasized the young age at which he committed the offenses and a challenging upbringing. McGavin, who has a prior conviction for shoplifting, maintained his innocence throughout the trial. His defense attorney argued for a suspended sentence, highlighting McGavin's isolation from society and his previous imprisonment on remand. However, Judge Eugene Egan ultimately sentenced McGavin to 30 months in prison, emphasizing the website's intended purpose of targeting vulnerable individuals and the potential for serious harm caused by such phishing scams. The judge acknowledged McGavin's computer skills and urged him to use them for legitimate purposes upon release. Detective Sergeant Jack Harris from Tarian, the southern Wales organized crime squad, cautioned the public about the dangers of fraudulent websites, stressing that cybercriminals will face prosecution.
