The evaluation of use of force by Lorain County SWAT team members in the January 13 death of Brian Dawson was released Tuesday by the Lorain County Prosecutor.
LORAIN COUNTY, Ohio -
Prosecutor J.D. Tomlinson concluded there was not an excessive use of force from the SWAT team during its hours-long standoff with Dawson at Sheldon Woods Reservation. Dawson, 59, pointed a gun at a ranger who approached him to tell him the park is closing. The ranger, identified as Matthew Pettry, retreated and called for backup.The standoff went until early the next morning, police say, and involved breaking the front windshield of Dawson’s car before Dawson fired his gun at SWAT officers and officers returned fire.
Tomlinson wrote that when Dawson pointed his gun at Pettry and others, Dawson “was actively resisting” any command or request that the officers would have made to Dawson, including his surrendering to arrest. the prosecutor also pointed out that when an officer is placed in fear of death or serious bodily harm by reason of a suspect’s use of deadly force, the officer may defend himself with deadly force.Man murdered inside Massillon movie theater: PoliceBrowns predicted to have the toughest NFL schedule
