A man who was shot by police while wielding two knives has been unsuccessful in his attempt to have his sentence reduced. Noel Quigley, 46, from Celandine Court in Londonderry, admitted to charges of attempted grievous bodily harm with intent and assault occasioning actual bodily harm in April 2021. At Londonderry Crown Court, a judge sentenced him to 18 months in custody followed by an additional 18 months on licence.

However, his appeal to the Court of Appeal for a lesser prison term was dismissed on Monday by Lady Chief Justice Dame Siobhan Keegan.The court heard that police responded to a 999 call reporting that a man had injected air into his veins. Upon arriving at Quigley's flat, officers found him in the living room, with a syringe lodged in his chest, threatening self-harm. Instead of complying, Quigley lunged at the officers with the knives, stabbing and slashing one of them about the head. The other officer fired a shot, striking Quigley in the chest, causing him to fall to the floor. Quigley received hospital treatment for the gunshot wound and subsequently made a full recovery. The injured officer sustained superficial lacerations to his head and arm that required medical attention and glue. Speaking at the appeal hearing, the wounded officer expressed the profound impact of the incident, stating, 'I do not believe we should be subjected to these traumatic incidents. This incident will have a lasting impact on my life as well as my family and other colleagues which would have been prevented if Mr Quigley complied with police instructions on that evening.' During his interview, Quigley claimed that the police's use of a spray triggered a 'blind panic' during his serious attempt to take his own life. It was also argued that Quigley's responsibility for the attack was reduced because he was suffering from mental impairment at the time. The judges ultimately upheld the original three-year sentence, deeming it proportionate to the circumstances and not manifestly excessive
