Marketing manager Emily Scott, 26, wept and hugged her mother at Chester Magistrates Court after her drink-driving charges were dismissed.
A Manchester Utd executive who flipped her VW Polo has beaten a drink-driving charge after prosecutors failed to prove she was twice the legal alcohol limit.
The defence also said there was even 'difficulty' with identifying who was driving the Polo at the time of the crash. Tests showed the Man Utd executive had 66 micrograms of alcohol in 100 millilitres of breath, the legal limit being 35mg, and she was taken to the local police station where a further test showed 143 mg of alcohol per 100ml of blood with the legal limit being 80mg.
Her barrister Phillip Lucas, a specialist in defending in motoring cases who advertises his successes online, told the hearing the expert's dossier of evidence should have been served by May 28, but was not received by him until August 9 and had calibration certificates missing. 'The defence takes issue with the reliability of the analysis in this case and is in dispute. The Crown should have served its case and expert evidence so we would have sent it to our own expert. That is what should have happened. But we have got less time to consider it.
He also said he had come into possession of the missing information the defence had requested, and so was able to supply it on the day, giving the defence team all that they had requested.
