A special unit with the Minnesota Attorney General’s Office says the 2001 murder conviction of a 62-year-old Minnesota man should be overturned. Brian Pippitt has been incarcerated for over two decades. He was convicted for the 1998 murder of 84-year-old shopkeeper Evelyn Malin.

On Thursday, June 6, 2024, a special unit of the Minnesota Attorney General’s Office said that Brian Pippitt, who has been held in the Fairbault Prison after he was convicted of murder in 2001, should be exonerated.
“No person or community is safer, and justice is not served, when an innocent person is convicted and imprisoned,” he said. “Brian Pippitt had nothing to do with this murder, he wasn’t involved at all. And he’s been wrongly incarcerated for 25 years,” Cousins said. “This is just a gross injustice that continues every day.”
The case relied on testimony from co-defendants who were given favorable plea deals and sentencing recommendations in exchange for their cooperation, investigators with the Conviction Review Unit found. Both witnesses have since recanted their testimony.
