150,000 learning disabled children are locked out of their savings because they lack mental capacity to open a bank account - Andrew Turner writes about his campaign to get the Government to see sense

We found out by responding to the letter. We spoke to our child trust fund provider about getting the money to buy the bike. To our surprise they said “no” and advised us to speak to a solicitor. When we did, they told us we faced a long and expensive court application. They said that with just one savings account, it would be easier and cheaper to wait until Mikey died, because then a simpler process could be used. It was absurd and deeply upsetting.

Ministry of Justice records show that in 2021 there were only 20 court applications involving a single Child Trust Fund. When parents encounter the high barrier of court action, most are surrendering. This means thousands of disabled young people are being permanently locked out of their accounts, with an estimated loss of benefit to them of more than £300m.

They got together to design a simple new process that could be used across the industry and were lobbying the Government to support their proposals. In December 2020, OneFamily – the UK’s largest Child Trust Fund provider – started using the new process to help families. Most firms have since followed their lead. It is a sticking plaster that has helped an estimated 1,000 families, but the need for a Government-backed solution remains.
