Justice Fitzgerald, 21, says in a lawsuit he was slammed against a wall and thrown out for wearing a turban inside the Homestead Bar & Kitchen in Morristown.

A Muslim man has filed a discrimination lawsuit against the owners of the Homestead Bar & Kitchen in Morristown accusing the establishment of forcibly removing him from the bar for wearing a turban in observance of his religion.

The Homestead Bar & Kitchen, located in downtown Morristown, bills itself as “a popular late-night or happy hour hangout” and “the perfect place to gather.” “We don’t discriminate at all. Suffice to say, there are other sides to this story,” the spokesperson said. The manager and another worker then grabbed Fitzgerald by the arm and tried to force him out of the bar, according to the suit.

Fitzergald’s lawsuit alleges assault and battery, negligence, and a violation of the New Jersey Law Against Discrimination based on Fitzgerald’s religion, claiming the business failed to train employees on anti-discrimination policies.
