The rail operator will appear in court next month after the deaths of two members of staff and one passenger when a train detailed in Carmont on August 12, 2020. Driver Brett McCullough, 45, conductor Donald Dinnie, 58, and passenger Christopher Stuchbury, 62, died during the fatal crash.
It comes after an investigation by the UK Department for Transport's Rail Accident Investigation Branch concluded that the crash had been caused by wrongly-built drainage trench which led to debris being washed onto the track. The findings of the report, which were published last March, made 20 safety recommendations and called for improvements to the way Network Rail managed lineside drainage.
The Crown Office said it will be under a “section 76 indictment”, where a guilty plea has been offered.
