A new trial has been set for a man who has spent nearly two decades in prison.He was convicted of murder in 2007 and sentenced to 26 years in prison for the death of Juan Munguia .
Munguia was attacked from behind by two men in the 5400 block of Chaumonte Drive while unhooking his family's taco trailer from his truck.Humphrey's defense counsel said a potential witness was not disclosed to them at the trial. The defense also claims two men who were friends and facing unrelated charges agreed to testify for favorable deals in their upcoming cases.
The motion for a new trial claims police interviewed a high school student whose testimony was not disclosed to the defense. That high school student, now an adult, signed an affidavit claiming the men who testified against Humphrey lied to prosecutors. The prosecutor's office said Conviction Integrity Unit completed its investigation on Feb. 23 and that Humphrey was "unavoidably prevented from discovering evidence that would have been potentially helpful to his defense."
“The Conviction Integrity Unit was established to review and investigate claims of wrongful conviction,” said Anthony Pierson, deputy chief counsel for the prosecutor’s office. “Based on the CIU’s findings after an exhaustive review of the case, our office agrees with the CIU’s recommendation that Mentae Humphrey be granted a new trial.”
